Kim Davis Released from Jail
Rowan County Clerk Kim Davis returned to work after a short, 5 day stint in jail for refusing to issue a marriage license to a same sex couple then ignoring a judge’s order to issue the license.
Kim Davis refused to issue a same sex marriage license to a couple then ignored orders from the U.S. Supreme Court and was arrested and sent to jail on September 3. Even though Davis is out of jail, her argument is still ongoing. Davis, along with her attorney, have most recently file an appeal last Friday, asking that the issuing of the licenses be delayed. If the Supreme Court does not answer soon, she will have to decide whether to appease the courts demands and issue the licenses, or disobey the judge yet again and risk going back to jail. U.S. District Court Judge David Bunning says the mandate he issued is meant to be applied to all couples, not just couples fitting a certain mold. Davis’ attorney yet again argued against Bunning’s mandate, saying it was issued improperly and has asked for a delay.
Kim Davis’ primary argument that she cannot issue a license against her religious beliefs has been shot down by the U.S. Sixth Court of Appeals by arguing that the Clerk of the Rowan County does not possess the power or the right to disobey the United States Constitution.
Kim Davis was released from jail September 8. As she left the jail, she walked alongside Presidential candidate Mike Huckabee to a cheering crowd and a classic, “Eye of the Tiger”. In a news conference before returning to work, Davis still seemed defiant. She said she “faced an impossible choice… my conscience or my freedom” and requested her name be taken off all marriage license being issued by her office and wants it to be indicated that the licenses are being issued under federal authority.
